Vocalist Terms of Service

1. Agreement to Terms

By accessing or using Vocalist on iOS, Android (including prerelease versions), or the web, creating an account, or continuing a subscription, you agree to be bound by these Terms of Service and all incorporated policies, including our Privacy Policy. If you disagree, do not access or use Vocalist.

2. Eligibility & Accounts

Vocalist is designed for adults aged 18 and older. By using the service you confirm that you meet this requirement or that you have received verifiable parental consent as required by applicable law. You are responsible for maintaining accurate account information and safeguarding your login credentials.

You must notify us immediately at admin@lamardelimited.com if you suspect unauthorized access. You are accountable for all activity that occurs under your account until you report it.

3. Subscriptions & Billing

3.1 Purchases

Access to premium Vocalist features requires a paid subscription processed by Apple (iOS App Store), Google (Google Play Store), or Paddle.com for our web-to-app experience. By purchasing you agree to the applicable platform’s payment terms and refund policies.

3.2 Renewal & Cancellation

Subscriptions automatically renew for the selected term unless cancelled at least 24 hours before the renewal date. Manage your plan through the billing platform you used (Apple, Google, or Paddle). We cannot cancel, refund, or prorate subscriptions purchased through third-party stores; please follow their instructions.

3.3 Trial Offers & Discounts

Trial periods or promotional pricing may change at any time. If you do not cancel before a trial ends, the subscription converts to a paid plan at the standard rate.

3.4 Taxes

Prices may exclude taxes or fees required by law. Apple, Google, or Paddle will calculate and collect applicable taxes during checkout.

4. User Content & Licenses

Vocalist allows you to upload songs, audio recordings, lyrics, comments, and other creative works (collectively “User Content”). You retain ownership of your User Content, but you grant Lamarde Limited a worldwide, royalty-free, non-exclusive license to host, store, reproduce, adapt, publish, publicly perform, display, and distribute your User Content solely to operate and promote Vocalist, including community features and marketing showcases.

You confirm that you have the rights necessary to upload and share your User Content and that it does not infringe the rights of third parties. You can delete your User Content at any time through the app; however, cached or backup copies may persist for a limited period.

If you submit feedback or suggestions, we may use them without restriction or obligation to you.

5. Community Guidelines & Prohibited Conduct

Our mission is to cultivate a supportive creative community. You agree not to:

• Violate any applicable law, third-party rights, or contractual obligations.
• Upload content that is defamatory, hateful, harassing, obscene, deceptive, or infringes intellectual property.
• Share another person’s personal data without permission.
• Attempt to gain unauthorized access to accounts, systems, or networks.
• Use bots, scripts, or unauthorized tools to scrape or interfere with Vocalist.
• Reverse engineer, decompile, or otherwise attempt to derive source code except where permitted by law.
• Engage in fraudulent activity, such as artificially inflating play counts or reviews.

We may remove content or suspend accounts that violate these rules or jeopardize the safety of the community.

6. Our Intellectual Property

All rights, title, and interest in Vocalist—including the software, design, graphics, audio exercises, lesson content, trademarks, and logos—are owned by Lamarde Limited or our licensors. You receive a limited, revocable, non-transferable license to use Vocalist for personal, non-commercial purposes in accordance with these Terms. You may not copy, distribute, modify, or create derivative works without our express written consent.

7. Third-Party Services

Vocalist integrates with third parties, including Apple, Google, Paddle, Amplitude, Apphud, Adjust, and Facebook for support. These services have their own terms and privacy policies, which govern your use of their products. Lamarde Limited is not responsible for third-party services or content, and your dealings with them are solely between you and the provider.

8. Account Suspension & Termination

We may suspend or terminate your access to Vocalist at any time if you breach these Terms, misuse the service, or if required to comply with law. We will notify you when legally permitted. You may terminate your account at any time by contacting admin@lamardelimited.com or using in-app deletion features. Termination does not entitle you to any refunds, and sections of these Terms that by their nature should survive (including ownership, disclaimers, limitation of liability, and governing law) will remain in effect.

9. Disclaimers & Limitation of Liability

9.1 Disclaimers

Vocalist is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, statutory, or otherwise. We specifically disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not guarantee that Vocalist will be uninterrupted, secure, or error-free, or that results obtained from its use will meet your expectations.

9.2 Limitation of Liability

To the fullest extent permitted by law, Lamarde Limited and its directors, officers, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from or relating to your use of Vocalist—even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to these Terms or Vocalist will not exceed the amount you paid to us for the service in the 12 months preceding the event giving rise to the claim, or one hundred euros (€100), whichever is greater. Some jurisdictions do not allow certain disclaimers or limits, so portions of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Lamarde Limited and our affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of Vocalist, or your violation of these Terms or the rights of any third party.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Cyprus without regard to conflict-of-law principles. Any dispute arising out of or relating to Vocalist shall be brought in the courts of Cyprus, and you consent to their jurisdiction and venue. If mandatory local laws provide you with additional protections, those remain unaffected.

12. Changes to These Terms

We may update these Terms to reflect new features, legal requirements, or business practices. When we make material changes we will notify you via in-app notice, email, or by updating the “Last updated” date above. Continued use after the effective date constitutes acceptance of the revised Terms.
